Terms of Service

These terms explain what you can expect from eSEOspace and what we ask of you. We have kept them in plain language wherever we can.

    Agreement to These Terms

    These Terms of Service (the “Terms”) govern your use of eseospace.com and any website design, web development, SEO, GEO/AEO, maintenance, hosting or related service you purchase from eSEOspace (“eSEOspace,” “we,” “us”). By using this site or engaging us for work, you agree to these Terms.

    Where a signed proposal, statement of work or service agreement covers the same subject, that document controls and these Terms fill the gaps.

    Who We Are

    Scope of Work

    Every engagement is defined by a written proposal or statement of work that lists the deliverables, timeline and price. Anything not listed there is out of scope.

    Work that falls outside the agreed scope — new pages, added integrations, extra revision rounds, or a change in direction after a deliverable is approved — is quoted separately and begins only once you approve it in writing.

    Fees, Deposits and Payment

    Project work requires a deposit before we begin; the balance is invoiced per the schedule in your proposal. Monthly services (SEO, maintenance, hosting) bill in advance and continue until cancelled.

    Invoices are due on receipt unless stated otherwise. We may pause work on an overdue account after written notice. Orders placed through our online checkout are charged at the time of purchase.

    Prices quoted on this website are estimates for planning purposes and are confirmed in your written proposal.

    Your Responsibilities

    Projects move at the speed of feedback. You agree to supply the content, brand assets, access credentials and approvals we need, and to give us a single point of contact for decisions.

    You confirm you hold the rights to everything you give us — text, images, logos, fonts, video — and that our use of it will not infringe anyone else's rights.

    Revisions and Approval

    Each deliverable includes the number of revision rounds stated in your proposal. A deliverable is treated as approved once you confirm it in writing, or after ten business days with no response.

    Ownership of Deliverables

    Once your account is paid in full, you own the final deliverables produced for you — the design, the site content and the custom code written for your project.

    We keep ownership of anything that predates or sits underneath your project: our internal tooling, frameworks, component libraries, processes and know-how. You receive a perpetual licence to use those elements as embedded in your deliverables.

    Third-party components (themes, plugins, fonts, stock media, hosting and SaaS platforms) remain governed by their own licences, which pass to you as supplied.

    Unless you ask us in writing not to, we may show completed work in our portfolio and case studies.

    Results and Performance

    SEO, GEO and AEO outcomes depend on search engines, AI answer engines, your market and competitors — none of which we control. We apply current best practice and report honestly on what it produces, but we cannot guarantee a specific ranking, traffic figure, citation, lead volume or revenue result, and any figure discussed is an objective rather than a promise.

    Third-Party Services

    Delivery often relies on services we do not operate — hosting, domain registrars, payment processors, analytics, CDNs, email providers and plugin vendors. We choose them carefully but are not responsible for their outages, pricing changes, policy changes or discontinuation.

    Cancellation and Refunds

    You may cancel a monthly service at any time with written notice before the next billing date; the current period is not prorated and access continues to its end.

    If you cancel a project mid-stream, you are responsible for work completed and expenses committed up to that point. Deposits cover work already scheduled and are non-refundable.

    We may end an engagement, with notice and a refund of any unearned fees, if a project stalls for lack of feedback, if an account stays overdue, or if the requested work would breach these Terms or the law.

    Acceptable Use

    Do not use this website to break the law, infringe someone's rights, send unsolicited commercial messages through our forms, probe or disrupt our systems, or scrape it at a volume that degrades service for others.

    Confidentiality

    Each of us will protect the other's non-public business information and use it only to deliver the engagement. This does not apply to information that is already public, independently developed, or required to be disclosed by law.

    Disclaimer of Warranties

    This website and its content are provided “as is.” Beyond what your written agreement states and what the law requires, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that this site will be uninterrupted or error-free.

    Limitation of Liability

    To the fullest extent the law allows, eSEOspace is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim is capped at the fees you paid us for the service the claim relates to during the preceding twelve months.

    Nothing here limits liability that cannot be limited by law.

    Indemnification

    You agree to cover our reasonable losses and legal costs arising from content or materials you supplied, from your use of the deliverables after handover, or from your breach of these Terms.

    Privacy

    How we handle personal data is set out in our Privacy Policy, which forms part of these Terms.

    Governing Law

    These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts serving Placer County, California have exclusive jurisdiction, and both of us consent to that venue.

    Changes to These Terms

    We may update these Terms as our services change. The revision date at the top of this page always shows the current version, and continuing to use the site or our services after a change means you accept it.
